General Terms and Conditions of Sale (GTCS)

1. Preamble and Identity of the Seller

These General Terms and Conditions of Sale (hereinafter “GTCS”) govern the contractual relationship between :

On the one hand, the company AD Creative Lab, trading as Gamer Deer, registered under SIREN number 820 703 411, subject to VAT (VAT number : FR82820703411), whose registered office is located at 58 rue de Monceau, CS 48756, 75380 Paris Cedex 08, hereinafter referred to as the “Vendor” or “Gamer Deer”.

And on the other hand, any individual or legal entity making a purchase on the website gamerdeer.com, hereinafter referred to as the “Customer”.

2. Object

The purpose of these General Terms and Conditions of Sale is to define the terms and conditions of distance selling between the Vendor and the Customer, from the order to the services, including payment and delivery. They concern the sale of products and accessories related to the world of video games (gaming).

3. Products

The products governed by these General Terms and Conditions are those shown on the website gamerdeer.com. The products are described and presented as accurately as possible. However, there may be slight variations (particularly in terms of colour or packaging) due to the technical constraints of suppliers. These variations do not affect the validity of the sale.

4. Awards

Product prices are quoted in Euros (€) including all taxes taking into account the VAT applicable on the date of the order. Any change in the VAT rate may be reflected in the price of the products.

The Seller reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time the order is validated.

5. Control

All orders placed on the gamerdeer.com implies acceptance of these GTS. The ordering process comprises the following stages:

1. Select products and add to basket.
2. Validation of basket contents.
3. Login to the site or register.
4. Choice of delivery method.
5. Choice of payment method and acceptance of the General Terms and Conditions.
6. Payment confirmation.

Confirmation of the order implies acceptance of these terms and conditions of sale.

6. Payment

Payment is due immediately when the order is placed. The Customer may pay by credit card or via the secure payment services (e.g. PayPal, Stripe) offered on the site. The site uses a secure online payment system that encrypts the transmission of bank details.

7. Delivery and lead times

7.1. Shipping terms

Products are delivered to the delivery address indicated during the ordering process. To offer a wide range of products at competitive prices, Gamer Deer works with international logistics partners. Products can therefore be shipped directly from our partner warehouses located outside France (European Union or Asia).

7.2. Delivery times

The delivery times indicated on the site are average delivery times.

• Average time taken : 7 to 15 working days.
• The Seller makes every effort to meet these deadlines. However, these times may vary depending on logistical and customs constraints.

7.3. Customs duties

For deliveries from countries outside the European Union, customs duties or other local taxes may be payable. These duties and sums are not the responsibility of the Vendor. They shall be borne by the Customer and are the Customer's sole responsibility, both in terms of declarations and payments to the competent authorities.

8. Right of Withdrawal and Returns

In accordance with Article L.221-18 of the Consumer Code, the Customer has a period of 14 days from the date of receipt of the product to exercise its right of withdrawal, without having to give any reason or pay any penalty.

8.1. Return procedure

To exercise this right, Customers must notify their decision by e-mail to hello@gamerdeer.com. The Customer must return the product to the following French address: Altay Dagistan / Gamer Deer [Insert your return address in France here].

Important note: The cost of returning the goods shall be borne by the Customer.

8.2. Refund

The refund will be made within 14 days of receipt of the returned product by the Seller, using the same means of payment as that used for the order. The product must be returned in its original condition and complete (packaging, accessories, instructions).

9. Legal warranties

The Seller is liable for defects in the conformity of the goods with the contract (Legal Conformity Guarantee) and for hidden defects in the goods sold (Hidden Defects Guarantee). The Customer may make a claim under these guarantees by contacting support at hello@gamerdeer.com.

10. Intellectual Property

All elements of the site gamerdeer.com are and shall remain the exclusive intellectual property of the Seller. No one is authorised to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site.

11. Personal data

The Seller undertakes to maintain the confidentiality of the information provided by the Customer. Details can be found on the “Confidentiality Policy” page of the site.

12. Applicable law and disputes

These GCS are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing this, the French courts will have sole jurisdiction.

The Customer is informed that he/she may rIf you have a dispute, you can use conventional mediation, in particular with the Commission de la médiation de la consommation (Consumer Mediation Commission).
